The Inter-American Court of Human Rights has issued a judgment in the case of Olivera Fuentes v. Peru, and we are pleased to report that Compemedia members Andres Calderon, Francesca Chocano, and Jacqueline St Laurent were part of the Amicus Curiae submitted to the Court in this case.
The case of Olivera Fuentes v. Peru concerns a violation of Mr. Olivera Fuentes’ human rights to equality and non-discrimination, privacy, judicial guarantees and protection as a consequence of acts of discrimination based on the expression of his sexual orientation that occurred in a supermarket in 2004. Mr. Olivera Fuentes and his same-sex partner were reprimanded by the staff of the cafeteria “Dulces y Salados” of the Supermercado “Santa Isabel de San Miguel” for publicly displaying affectionate behavior.
The Amicus Curiae presented by our members of Compemedia focused on the fact that the actions of the company and the omissions of the state agencies that heard the case constituted violations of Mr. Olivera Fuentes’ freedom of gender expression.
